UFW stages fake “strike” at plant nursery

The United Farm Workers staged a fake strike at a Dorris, California, plant nursery, misrepresenting the hundreds of contract workers, making false statements about conditions, and violating state law. The October 29 protest surprised the workers, who had not been notified in advance that the UFW would be there, speaking in their name, according to the Herald and News. “We don’t need a union,” said employee Margarita Saucedo. “We are already united.” On its Facebook page, the UFW claimed that…

Wall Street Journal describes ALRB-UFW “shake down” of workers

The ALRB and UFW are colluding to “shake down” farmworkers at Gerawan Farming, according to the Wall Street Journal. Alyssia Finley writes, “In the tradition of the Obama administration’s pro-union shenanigans with the National Labor Relations Board, California’s Agricultural Labor Relations Board (ALRB) has teamed up with the United Farm Workers union to shake down workers at the state’s largest tree-fruit grower. Gerawan Farming, a third-generation family farm in Fresno, is trying to fend off the attack.” The ALRB’s own…

UFW uses fake numbers & lies to ALRB to hide “smallness” of the union

A California administrative judge called out the United Farm Workers for faking its membership numbers, and for lying in testimony to conceal “the smallness of existing UFW membership.” Judge Mark R. Soble of the Agricultural Labor Relations Board (ALRB), said that UFW National Vice President Armando Elenes was “lying” when he said he couldn’t even estimate the paid membership of the declining union. The United Farm Workers has exaggerated its membership on its filings with the U.S. Department of Labor,…

Judge says UFW VP “Elenes was lying”

United Farm Workers Vice President Armando Elenes was “lying” to the Agricultural Labor Relations Board during testimony against Gerawan Farming, an ALRB judge has found. “I reach the inescapable conclusion that Elenes was lying” during his testimony, ALRB Administrative Law Judge Mark R. Soble stated in his 192-page ruling. “As a result, for me, this seriously undermined the credibility of Elenes as to his other answers.” In that same ruling, Soble said that the 2013 ballots of Gerawan farmworkers to decertify the…

Allegations of bias dog Silas Shawver as he leaves ALRB

As Silas Shawver leaves the ALRB under a cloud – following the sacking of his boss, Sylvia Torres-Guillen – continued allegations of bias continue to mount. An exchange of correspondence between labor attorney Paul J. Bauer and Shawver show a hailstorm of acrimony – and a pile of carefully organized evidence that remove all doubt about Shawver’s potentially illegal bias in favor of the United Farm Workers (UFW) union. The original correspondence takes up six pages (available here Bauer letter to…

Fresno Bee runs page-one story on ALRB bias toward union

In a landmark development, the Fresno Bee has run a page-one story about ALRB bias toward the United Farm Workers (UFW) union. The story is important because it shows that bias complaints against ALRB go beyond Gerawan Farming and the farmworkers – and because of the many questions that ALRB refused to answer. Just as PickJustice.com has been saying, the controversy centers on disgraced ALRB general counsel Sylvia Torres-Guillen, who was removed from office suddenly last June. However, the Fresno Bee…

Is ALRB impartial? This video tells who’s who

Jessica Arciniega Alegria De La Cruz and Silas Shawver are in Cahoots at the ALRB

Key members of the California Agricultural Labor Relations Board (ALRB) staff have a revolving door relationship with the United Farmworkers (UFW) union. Their bias is in direct violation of state law, which requires the ALRB to be impartial. These revolving-door staff lawyers have been major players in the controversial, expensive, and possibly illegal ALRB prevention of farmworkers from having their votes counted to decertify the UFW. These cronies move between the union and the state agency taking care of union…

UFW organizer coached workers to lie to discredit de-certification vote

A former UFW organizer has testified in court that he coached Gerawan farmworkers to lie in order to undermine the vote to de-certify the union. The organizer said he died so on instructions from the union’s leadership. The former union organizer reportedly is in hiding for fear of retaliation from the UFW and the state Agricultural Labor Relations Board (ALRB). “The ALRB used lies manufactured by the UFW labor union to put a halt to the Gerawan farm workers’ efforts…

Silas Shawver of the ALRB Jumps For The UFW!

Silas Shawver Jumps For The UFW

The Agricultural Labor Relations Board is an independent governing body that oversees relations between California Central Valley farmers and the United Farmworkers of America, the union that wants to represent them. The ALRB is supposed to be unbiased. But if that’s so, WHY is Silas Shawver, their regional director, seen here wearing a UFW tshirt? Is it a harmless mistake? Considering that Mr. Shawver is pushing to destroy ballots in the farmworker’s election to decertify the union, it’s more likely…

Farmworkers are better off without ALRB-UFW protection racket

Gerawan farmworkers voted to give their trust to Cesar Chavez’s United Farm Workers (UFW). In 1990, they voted to certify the UFW as their collective bargaining representative. Then the UFW disappeared. For twenty years, Gerawan farmworkers heard nothing from the UFW. The UFW never communicated with them. Nobody from the UFW came out to the fields to talk to them. The UFW never negotiated a contract for them. Joining the UFW, as UFW first vice president Irv Hershenbaum told council members in…

UFW has built a track record of perjury and other deception

Since Cesar Chavez died in 1993, the United Farm Workers (UFW) has built a track record of deliberate and willful deception to keep its credibility while its membership leaves in droves. Instead of continuing the Chavez legacy of working hard for the farmworkers, it has practically ignored its members. It used lies – even orchestrated perjury – to stay relevant. UFW lied to Gerawan farmworkers, and is now lying about them A case in point is the work force at…

ALRB can double UFW’s payroll by taking Gerawan workers’ 3%

By forcing Gerawan farm workers to pay 3 percent of their gross wages to the union, the ALRB would be able to double the UFW’s annual payroll. In documents it filed with the U.S. Department of Labor, UFW reported that it has an annual payroll of $3.2 million. Some of its top executives have been on the UFW payroll for 40 years or more – guaranteed jobs for life. By forcing an estimated 5,000 Gerawan farm laborers to pay 3…

Fresno Bee shows farm workers shouting down UFW

Hundreds of farm workers shouted down UFW organizers outside a state courthouse in Fresno April 14. The Fresno Bee covered the confrontation on video. Orange-shirted UFW organizers can be seen holding signs seeking to compel the workers to accept a contract, with the workers responding with chants of “Fuera!” meaning “get out of here” or “go away.” Judging by the video, the UFW had more signs than people to hold them. In an accompanying article, the Fresno Bee reports that,…

Forbes: ALRB is ‘refusing to count’ farm workers’ votes

The ALRB is refusing to count the votes of farm workers who don’t want to pay 3 percent of their income to a union that they feels doesn’t represent them. “The workers, from Fresno-based Gerawan Farming, voted in a decertification election last November to rid themselves of the United Farm Workers (UFW) union once and for all,” Forbes reports. “But the authorities at the California Agricultural Labor Relations Board (ALRB) are refusing the count those votes. For almost a year…
